Rental Agreement
Agreement
This contract represents the only rental agreement between Homes 2 Stay website, owned, managed and operated by KOOL SPOT BOOKINGS LLC. based in Lisbon, Portugal (referred in this rental agreement as "H2S") and the user (referred in this rental agreement as "Guest") that intends to book one of our listed properties, and replaces all prior bonds (oral or written) regarding the subject matter and can only be changed in writing, when signed by both parties.
Rates
The rates mentioned at H2S are established by its property owners and/or its partners and refer to each property and each night. The rates may vary, depending on the time of year, number of people and number of days.
Eventual discounts (for last minute reservations, stays up to 7 days, 30 days, or between 1 and 3 months) or additional fees will be mentioned at the time of reservation and will be included in the final price.
Reservation | Payment
To hold your reservation, we require a booking deposit. The amount will depend on the property being booked.
To confirm your reservation, you will be asked to pay a booking deposit 15% to 50% of the property’s total rental amount, depending on the chosen property, number of people, duration of stay and selected period. This payment can be made either by credit card (PAYPAL, extra charge fee of 5% will apply) or by bank transfer. The remaining balance should be paid in CASH at the moment of check-in or by any other alternative payment method by prior agreement with the property owner, or as specified in the property’s special conditions section.
The reservation will only be confirmed to you through email, when the payment is confirmed in our bank account.
In the case of a wire transfer, the proof of bank transfer must be sent to us by e-mail to: bookings@homes2stay.com, within 48 hours of the booking process.
Damage Deposit
In some cases, the property owner may request a damage deposit, therefore you must consult your chosen property’s details section.
The damage deposit will not be returned if any of the following situations occur:
* You don’t return the keys which you received at check-in;
* You don’t leave the property by the established check-out time;
* You damage the property, furniture or other equipment;
* You have more guests than indicated on your booking form;
* You leave the property in an unreasonably dirty state;
Cancellation
If you cancel your reservation, the booking deposit will not be refunded, even if you cancel it more than 30 days prior to your arrival.
As far as the remaning balance of your stay is paid, each property owner establishes the conditions regarding cancellations, so please check the property’s details section which conditions will apply in this situation.
For a fully paid reservation, there is a cancellation charge that will depend on the number of days before the beginning of the rental period:
- More than 90 days before: 20% of the total amount;
- 60-89 days before: 30% of the total amount;
- 30-59 days before: 50% of the total amount;
- Less than 30 days before: 100% of the total amount;
H2S recommends that you take out a Travel Insurance which covers you in case of cancellation or booking changes.
In exceptional cases, our properties may already have been booked after your confirmed payment, for reasons beyond the control of H2S.
In such cases, we shall offer another property of an equivalent price.
If one of our properties is not available, H2S will not be responsible for any extra cost which guests may incur ensuring alternative accommodation. If it is not possible to find alternative accommodation for our guests we issue a full refund for the amount already paid.

Booking Changes
Reducing/Adding the number of nights
You can only reduce the number of nights 30 days prior to your arrival. In order to do so, you have to inform us by sending an e-mail to bookings@homes2stay.com. On that e-mail you should also quote your reservation number.
The deposit payment will not be refunded.
You can add more nights, if the property remains available. In order to do so, you have to inform us by sending an e-mail to bookings@homes2stay.com. On that e-mail you should also quote your reservation number.
Reducing/Adding the number of guests
You can only reduce the number of guests 30 days prior to your arrival. In order to do so you have to inform us by sending an e-mail to bookings@homes2stay.com quoting your reservation number.
The deposit will not be refunded.
You can add guests as long as the capacity of the property is not exceeded. You should send us an e-mail to bookings@homes2stay.com. Only after the payment of the difference between the price that has already been charged at the moment of your initial reservation and the final price, we will then confirm the changes concerning to your reservation.
Arrival | Departure
To learn more about the Check-In schedule, you should consult the property’s details section.
In some cases, our property owners will allow you to store your luggage in the property, prior to the standard check-in time, but you need to check this in the property’s details section.
Before arrival, you should call the contact person provided on the confirmation e-mail, or alternatively you can call H2S.
In some cities an extra fee may be charged, depending on the schedule and arrival/departure day. You may check this information on the property’s details section. Therefore it is very important to know the time of your arrival/departure, and it is extremely useful, if you are able to give us this information when you book.
Please note that you must have a copy of your ID Card or Passport, when you Check-in, or alternatively, you can email it to bookings@homes2stay.com, quoting your reservation number.
Liability for Early Departure
The guest will not be entitled to a refund if he/she leaves the property before the end of the scheduled stay.
Cleaning
The property will be cleaned prior to the arrival of each tenant.
When leaving the property, the Guest is expected to leave it in a reasonable condition. Otherwise, the property owner may ask for an additional fee for cleaning services.
In some cases a cleaning fee may be applied, but such will be explained in the property’s details section, on the website.
If you need extra cleaning/maintenance services during your stay, you should request it when booking, or at check-in. An additional fee will apply.
Number and identity of the guests | pets allowed
H2S must know the exact number and age of the guests.
The number of guests must not exceed the property’s capacity.
Guests must check if pets are allowed. This situation varies depending on the property and should be confirmed in its details section.
Behaviour
The tenant signing the check-in form is from that moment responsible for the correct and decent behaviour of all people staying in the property. Therefore he or she is responsible for any illegal activity or any behaviour that may endanger public health, practised by people staying in the property.
Some of our properties are part of residential developments and therefore Guests are expected to respect their neighbours, avoiding late night activities (between 10 PM and 10 AM).
Failure to respect this will result in immediate eviction from the property without refund.
Responsibilities | Complaints
H2S aims to respond with the maximum quality and efficiency to it’s guests expectations. Therefore it is very important that you provide us with as much detail as possible about the type of property you are looking for.
H2S is an intermediary between the guest and the property owner and/or its partners. Some properties are completely managed by us while others are under the management of their owners and/or its affiliates. In both cases, H2S will not be held responsible for the material condition of properties or for any other issue that may arise between the Guest and the owner.
H2S establishes by prior agreement with the property owner and/or its partnes, all the rental conditions according to our high standards (including furniture, maintenance, comfort) that must be ensured to the client at check-in.
The descriptions of properties as presented on the H2S website are based on the information provided by the owners, which is subject to change at any time without prior notice. The owners and/or affiliates remain responsible for the accuracy of these descriptions, as well as for changes of pricing and availability of the property. H2S is responsible for updating all information but will not be held accountable for any omissions or errors with regard to that information.
If during your stay, you verify that the property doesn’t match the description on the site, it is important that you contact us immediately, so that the problem can be solved as quickly and effectively as possible. If during your stay any damage or maintenance problems should occur, you must immediately contact the owner, the person responsible for the property, or alternatively, H2S.
Any complaints that may arise due to situations about which H2S has had no prior knowledge will not be refunded or compensated for by H2S.
H2S and the owners are not responsible for any damage or losses that may occur due to the bad usage of the properties. These include robbery, insecure and criminal behaviour, drug use, inappropriate use of the properties equipment by children, elderly people or people with disabilities, when not under supervision. The same applies to other utilities such as gas, electricity, water, telephone and internet supply services.
H2S advises all guests to be careful in their use of all gas appliances and expects Guests to disconnect these when leaving the property at the end of their stay.
The leasehold of the properties by H2S in various cities of the world is solely intended for short term residential purposes of special transitory nature, in accordance with article 1095, number 3 – Local Lodging – of the Portuguese Civil Law (Código Civil Português). We do not provide our guests with lodging offers in legally managed touristic complexes, as established by the Law Decret 39/2008 of March, 7th.
H2S and its guests agree that this agreement shall be governed by Portuguese law, and that if a dispute arises from this contract, both parties recognize the District Court of Lisbon (Tribunal da Comarca de Lisboa), with express waiver of any other instance.
